NEW DELHI: Attorney general K K Venugopal, appearing for Maharashtra State Board of Wakfs in Supreme Court since 2011 when he was a senior advocate, has shot off a fresh letter to the SC saying those behind the series of contemptuous events that took place on August 1 are “bent upon ensuring that the AG does not argue this case”.
In his August 8 letter, the AG said, “No instructions for me to appear in the case were received after the change of advocate on record.”
On August 2, the AG made a huge complaint to a bench headed by CJI N V Ramana about shabby treatment at the hands of his client, the minority affairs department of state government, which unceremoniously replaced the counsel who have been assisting him for a long time – advocate on record Sudhanshu Choudhary, special counsel Javed Shaikh, and senior advocate Gopal Shankaranarayanan.
In his fresh four-page letter to the secretary general of the SC with a request to place it before the CJI, the AG said, “Looking at the entirety of what has emerged, it seems that whoever is behind the events that have transpired, whether it is the beneficiaries of the transfer of anyone else, is bent upon ensuring that the attorney general does not argue this case”.
Reviving the debate – Does the client have absolute freedom at any point of time to disengage a lawyer from the case, the AG said, “… this interference with counsel, being officers of the court, and the attempt to remove the entire team just on the eve of the hearing (on August 2) was in gross contempt of court. In my letter (of August 1), I also sought action for contempt being taken against the persons responsible whoever they be, whether beneficiaries or otherwise for contempt of the Supreme Court of India.”
Like on August 1, Venugopal in his August 8 letter asserted his right to appear as AG in any matter of public importance as mandated under Article 76(3) of the Constitution, which confers on him the right of audience before any court in the country.
