NEW DELHI: The Serious Frauds Investigation Office (SFIO) has arrested one person named Dortse, the alleged mastermind of a widespread racket involving setting up of shell companies with Chinese links and supply of dummy directors.
The move follows searches conducted by the ministry of corporate affairs (MCA) last week which included those on the Gurgaon offices of Jillian Consultants India, a wholly owned subsidiary of Jillian Hong Kong, Fininty in Bangalore and Husys Consulting in Hyderabad. Although SFIO has arrest powers, it has used it sparingly.
The latest development marks a widening of the scope of investigation against entities related to Chinese companies, which have been under the lens of multiple agencies including the income tax department and the directorate of enforcement. Facing multiple restrictions for the last two years, including those related to FDI, Chinese companies have allegedly used shell companies to invest in India or take funds out of India.
Dortse, who has shown himself as a resident of Mandi in Himachal Pradesh, is on the board of Jillian India.
“Evidence procured during the enquiry by registrar of companies (RoC) Delhi and the simultaneous search operations clearly points to dummy directors being paid by Jillian India to act as dummies in several shell companies. Boxes filled with company seals and digital signatures of dummy directors have been recovered from the site,” an official statement said.
The Indian employees were in touch with their Chinese counterparts through a Chinese instant messaging app, it added.
Husys, which was earlier listed on exchanges, was also found to be acting on behalf of Jillian India. “Initial observations reveal that Husys had a pact with Jillian Hong Kong. Investigations so far have revealed the possible involvement of these shell companies in serious financial crimes detrimental to the financial security of the country,” the statement added.
Apart from Jillian Consultants, 32 other companies were probed by MCA, which revealed that Dortse and a Chinese national are the two directors in the Gurgaon-based company.
The arrest took place as Dortse fled to Bihar and was allegedly planning to escape from the country by road. “Immediately, a special team was constituted in SFIO which was deputed to the said remote place. In the evening of 10 September, 2022, SFIO had arrested Dortse, who was later produced in the jurisdictional court and orders for his transit remand were obtained,” the statement said.
