MUMBAI: In his final statement submitted in the 2008 Malegaon blast case before the special NIA court on Tuesday, accused retired major Ramesh Upadhyay alleged he was “falsely framed” by the state’s Anti Terrorism Squad (ATS) due to political pressure exerted upon them by then UPA govts in office at the Centre and state, to somehow justify their Hindu terror theory.He said the “ATS created evidence against him with sinister motives to please political masters”.
Upadhyay, who is out on bail, also claimed he was not only physically tortured and mentally harassed while in ATS custody, but psychological pressure was also mounted upon him by threatening his house owner for “sheltering” a terrorist.
“I was threatened that my wife will be paraded naked, my unmarried daughter would be raped, son’s jaw would be broken, and to execute the threat, they started visiting and searching the houses of my married daughters to insult them and their in-laws in the society and to further mount psychological pressure on me to confess to a crime I hadn’t committed,” he said. He also alleged senior police officers, such as then DGP Maharashtra A N Roy, threatened to “pulverise” him.
“When I flatly refused to bow down to their wishes to give a confession or falsely name or implicate any other person or a co-accused, they arrested me on Diwali night and produced me before judicial magistrate Nasik the next day, which was again a holiday. I spoke to… JMFC (judicial magistrate first class), showed him torture marks on my body, agreed to co-operate with investigation and also to Narco Analysis Tests to prove my innocence,” Upadhyay said, adding subsequent tests exonerated him. “I have not attended any alleged meeting. Allegations that voices, alleged to be mine, in the transcripts are bogus, false and fabricated. I deny any alleged conversation with any co-accused,” he said. Last week, Lt Col Prasad Purohit, also accused in the case, in his final statement had accused senior police officers of carrying out a fabricated probe to suit the govt of the day.
